  1. GENERAL PROVISIONS

1.1. These purchase and sale rules (hereinafter – the Rules) govern the mutual rights, obligations, and responsibilities of the buyer purchasing goods in the www.fortactical.com online store (hereinafter – the Buyer) and the seller – FOR TACTICAL, UAB (legal entity code 307195698, registered address: Merkinės st. 7-12, LT-66264 Druskininkai, Lithuania, email: admin@fortactical.com, tel.: +37068585958) (hereinafter – the Seller).

1.2. By purchasing goods at www.fortactical.com, the Buyer confirms that they have read the Rules and agree to abide by them.

1.3. The Seller has the right to change the Rules. The version of the Rules valid at the time of order submission applies to the Buyer's purchase. It is recommended to review the current version of the Rules before each purchase.

1.4. The right to purchase at www.fortactical.com is granted to:    a) Fully capable adult natural persons;    b) Minors aged 14–18, with the consent of their parents/guardians or independently disposing of their income;    c) Legal entities (companies, organizations);    d) Authorized representatives.

1.5. The Buyer is responsible for the accuracy of the data provided and confirms that they have the right to conclude a purchase and sale agreement.

1.6. Special conditions may apply to business customers (B2B), about which the customer is informed individually.

  1. PRIVACY AND PERSONAL DATA

2.1. Personal data is processed in accordance with the procedure established in the Privacy Policy: www.fortactical.com/privatumo-politika.

2.2. Data necessary for order fulfillment: name, surname (or company details – name, company code), delivery address/parcel locker, telephone number, email address.

2.3. For the purpose of order fulfillment, the Buyer may be sent necessary notifications by email and/or SMS messages; marketing messages – only with separate consent.

2.4. Registration data of legal entities are processed in accordance with the requirements of legal acts.

  1. CONCLUSION OF THE AGREEMENT

3.1. Prices are indicated in euros, including VAT (if applicable), unless otherwise stated. The price displayed at the time of order submission is valid.

3.2. The agreement is considered concluded when the Buyer, having formed a shopping cart and filled in the necessary data, clicks "Confirm Order / Pay" and makes a payment or chooses a permitted payment method.

3.3. The Buyer receives an automatic order confirmation by email with the order number and information.

3.4. If prepayment is selected, the order is executed upon receipt of funds into the Seller's account. Payment must be made within 3 business days from the date of order submission; if payment is not received, the order may be cancelled.

3.5. The Seller reserves the right to cancel the order if:    a) The goods are not in stock due to unforeseen circumstances;    b) The information provided is incorrect or incomplete;    c) Technical errors in price setting (obviously incorrect price);    d) The Buyer has violated previous purchase and sale agreements.

3.6. If the order is cancelled due to the Seller's fault, all money paid will be refunded within 3 business days.

  1. PRICES AND PAYMENT

4.1. All prices are quoted in Euros and comply with the legal requirements of the Republic of Lithuania regarding price indication.

4.2. The final amount includes the price of the goods, delivery costs, and other additional charges (if applicable).

4.3. Payment methods:    a) Online banking;    b) Bank card (Visa, Mastercard);    c) Google Pay / Apple Pay;    d) Paysera;    e) Bank transfer (for business clients based on the issued invoice);    f) Other payment methods indicated during the order process.

4.4. Payments are processed by the Seller or its chosen payment service providers.

4.5. The invoice (or purchase receipt) is provided to the Buyer electronically no later than 2 business days after the goods are handed over or payment is received.

4.6. An invoice is issued to business clients if the company details are provided during the order process.

  1. DELIVERY AND COLLECTION

5.1. Delivery methods:    a) Omniva to a parcel locker in Lithuania;    b) Omniva courier to the address indicated by the Buyer in Lithuania;    c) International delivery to other EU countries (according to separately established rates);    d) Collection at the Seller's warehouse (if this service is offered).

5.2. Specific delivery terms and conditions (deadlines, rates, restrictions, re-shipping procedure) are provided on a separate page: www.fortactical.com/pristatymas-ir-grazinimas.

5.3. The standard delivery time in Lithuania is 2-5 business days from confirmation of payment. Exact delivery times are specified in the order confirmation.

5.4. When ordering customized goods (with printing, embroidery, special inscriptions), the delivery time may be longer – up to 10-15 business days. The specific deadline is indicated during the order process.

5.5. Delivery from Ukraine: certain goods may be shipped directly from our partners in Ukraine. In this case, the delivery time may be 7-21 business days, and the exact deadline and additional information are indicated in the product description and/or order confirmation.

5.6. The Buyer must provide correct delivery details and ensure the collection of the shipment. By disclosing collection codes or the order number to a third party, the Buyer assumes the risk of collection by an unauthorized subject.

5.7. Upon receipt of the shipment, it is necessary to inspect the packaging before signing the delivery document (if applicable). If any damage, discrepancies, or defects are noticed, do not accept the shipment, draw up a report with the courier, and immediately inform the Seller by e-mail at admin@fortactical.com.

5.8. If the Buyer does not collect the shipment within the period specified by the carrier (usually 7 calendar days for parcel lockers), the Buyer pays the costs of resending and (or) return. The returned shipment is stored in the Seller's warehouse for 30 calendar days; if the Buyer does not respond, the item is returned to the warehouse, and the money paid (excluding delivery costs) is returned to the Buyer.

5.9. The Seller is not responsible for delivery delays due to the carrier's fault but undertakes to help resolve the situation.


REMOTE CONTRACT WITHDRAWAL. RETURNS AND EXCHANGES

6.1. The Consumer (a natural person purchasing for purposes not related to business) has the right to withdraw from the contract within 14 calendar days from the date of receipt of the goods without stating a reason, except for the exceptions provided for in legal acts (Article 6.22810 of the Civil Code of the Republic of Lithuania).

6.2. To return the goods, the Buyer must notify the Seller of their intention to return the goods within 14 days of receipt of the goods and actually return the goods within the same 14 days.

6.3. The return process, addresses, deadlines, costs, and forms are provided on the page: www.fortactical.com/pristatymas-ir-grazinimas.

6.4. Conditions for returning goods of good quality:    a) The item is unused (except for necessary inspection actions - examination, trying on);    b) Undamaged, in original condition;    c) Returned in the original, undamaged packaging;    d) With all labels, accessories, warranty documents;    e) Without signs of use, wear marks, or sweat odors.

6.5. Exceptions (goods that are not returned without quality defects):    a) Personalized items (with prints, embroidery, names, initials, etc. made to the Buyer's order);    b) Terminal undergarments, balaclavas, and other hygiene-sensitive items, if the original packaging is damaged;    c) Protective films or packaging elements are torn off, if this is necessary for the integrity of the product;    d) Other exceptions established in Article 6.22810(2) of the Civil Code of the Republic of Lithuania and Government Resolution No. 697.

6.6. Returns of personalized and custom-made goods: Goods made to individual orders (with prints, embroidered names, logos, special colors, or dimensions) are returned ONLY if they have quality defects or do not meet the order specifications.

6.7. In the case of goods of inadequate quality, the Buyer may demand termination of the contract and a refund of the money.

6.8. The Buyer must notify their intention to return the goods by e-mail to info@fortactical.com, indicating the order number and the reason for the return.

6.9. The item must be sent within 14 days of notification of the return. The Buyer receives the return address and instructions by e-mail.

6.10. The direct costs of returning the goods are borne by the Buyer, except in cases where the item is defective or the wrong item was delivered.

6.11. Money is refunded to the payer's account within 14 calendar days of receiving the notice of withdrawal; the refund may be withheld until the actual return of the goods to the Seller or the provision of proof of shipment.

6.12. Only the price of the goods is refunded; the initial delivery costs are not refunded, except in cases where the return occurred due to the Seller's fault (defective item or incorrect item).

6.13. Legal entities carry out the return of goods according to the general principles of contract law, unless the parties agree otherwise.

  1. PRODUCT QUALITY AND WARRANTIES

7.1. All goods sold at fortactical.com meet the quality requirements of the European Union and the Republic of Lithuania.

7.2. The goods are subject to a manufacturer's warranty (if provided) and the statutory period for ensuring quality (proportional to the nature and purpose of the goods).

7.3. The specific properties of tactical clothing (water-resistant fabric, strength, color fastness) are guaranteed according to the manufacturer's specifications stated in the product description.

7.4. Information on use, care, washing, and storage is provided in the product description and/or label. The warranty does not apply if care requirements are violated.

7.5. Screen settings, resolutions, and color profiles may cause differences between the actual color or shade of the item and the image shown in the photos - this is not a product defect in itself. If you have any doubts about the color, please contact info@fortactical.com before purchasing.

7.6. Natural wear and tear of tactical clothing during intensive outdoor use, mechanical damage due to improper use (e.g., snagging on sharp objects, burns), fading of colors due to too frequent or intensive washing are not considered manufacturing defects.

  1. DISCOUNTS, COUPONS, PROMOTIONS

8.1. Discounts are not cumulative with each other, unless explicitly stated otherwise in the terms of the promotion.

8.2. Gift vouchers and discount codes (if offered) are valid until the date indicated on the voucher and cannot be exchanged for cash.

8.3. Discount codes are applied only once per order, unless otherwise specified.

8.4. The Seller may change, suspend, or terminate promotions and discount programs without prejudice to the terms of already confirmed and paid orders.

8.5. In the event of incorrect application of a discount code or an obvious technical error, the Seller reserves the right to cancel the order or offer the correct price.

8.6. Special B2B discounts and loyalty programs may be offered to business customers individually.

  1. BUYER'S OBLIGATIONS AND RESPONSIBILITY

9.1. The Buyer undertakes to:    a) Pay for the goods according to the confirmed price and deadline;    b) Accept the goods in accordance with the conditions stipulated in the contract;    c) Comply with these Rules and the requirements of applicable laws;    d) Not disrupt the stability and security of www.fortactical.com and not use the website for illegal purposes;    e) Use tactical products in compliance with safety requirements and the intended purpose of the products.

9.2. The Buyer is responsible for the accuracy and completeness of the registration data and order information.

9.3. The Buyer is responsible for the confidentiality of the account login data (password) and for all actions performed when logged into their account.

9.4. If it is suspected that the login data has become known to third parties, the Buyer must immediately change the password and inform the Seller.

9.5. The Buyer confirms that the purchased tactical clothing items will be used for legal purposes (outdoor activities, sports, self-defense, professional functions) and will not be used for criminal purposes.


  1. SELLER'S RIGHTS AND OBLIGATIONS

10.1. The Seller undertakes to:    a) supply goods of adequate quality that conform to the descriptions;    b) fulfil orders within the agreed deadlines;    c) provide information about the availability of goods, delivery times, and other order details;    d) handle complaints in accordance with the procedure established by law.

10.2. For technical reasons, security assurance, maintenance work, or force majeure events, the Seller may temporarily or permanently suspend the operation of the website, informing about it on the website as much in advance as possible; this does not affect the execution of already concluded contracts.

10.3. In the event of a breach of the Rules or a threat to the security of the website, the Seller may restrict or cancel the Buyer's access to the account, suspend the execution of the order, or refuse further cooperation.

10.4. The Seller shall fulfil the Buyer's legitimate requirements regarding quality, returns, and other contract-related issues, and ensure the protection of personal data in accordance with the law (GDPR).

10.5. The Seller cooperates with reliable Ukrainian manufacturers and ensures the transparency of the supply chain. Information about the manufacturer may be provided upon request.

10.6. The Seller reserves the right to request additional documents to verify identity for higher value orders or in case of suspected fraud.

  1. INTELLECTUAL PROPERTY

11.1. All content on www.fortactical.com (texts, graphics, photos, product descriptions, logos, trademarks, design, etc.) is protected by copyright and industrial property rights.

11.2. Copying, distributing, or otherwise using the website content for commercial purposes without the Seller's prior written consent is prohibited.

11.3. The Buyer may use product photos and descriptions for personal, non-commercial purposes only (e.g., sharing on social media with attribution).

11.4. Trademarks and logos of Ukrainian manufacturers belong to their respective owners and are used with their consent.

  1. LIMITATION OF LIABILITY

12.1. The Seller is not liable for losses arising from:    a) incorrect or incomplete data provided by the Buyer;    b) actions or omissions of third parties (carriers, payment systems);    c) force majeure events – wars, natural disasters, pandemics, government restrictions, strikes, etc.;    d) malfunctions of the Buyer's equipment or internet connection;    e) improper use or maintenance of the goods, in violation of the instructions.

12.2. Considering the situation in Ukraine, the Seller is not responsible for delivery delays or non-performance of the contract if this is due to hostilities, disruption of transport infrastructure, delays in customs procedures, or other reasons related to the geopolitical situation. In such cases, the Seller informs the Buyer about the situation and offers alternatives (cancellation of the order with a refund or waiting until the normal situation is restored).

12.3. The Seller's liability is limited to the price paid by the Buyer for the goods, unless otherwise provided by law.

12.4. In the event of damage caused by the fault of one of the parties, the culpable party shall compensate the other party for direct losses (actual damage), but not for lost profits or indirect losses.

  1. COMPLAINTS AND DISPUTE RESOLUTION

13.2. The Seller undertakes to respond to the Buyer's complaint or request within 5 business days of its receipt.

13.3. Disagreements shall be resolved through negotiation. If an agreement cannot be reached, disputes shall be resolved in accordance with the procedure established by the laws of the Republic of Lithuania – in the courts of the Republic of Lithuania, in accordance with the substantive law of the Republic of Lithuania.

13.4. The consumer (natural person) has the right to contact:    a) The State Consumer Rights Protection Authority: www.vvtat.lt, email: tarnyba@vvtat.lt, phone 8 5 262 67 51;    b) Territorial divisions of the State Consumer Rights Protection Authority;    c) The European Commission's Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr;    d) The Consumer Dispute Commission at the State Consumer Rights Protection Authority.

13.5. Before applying to court, the consumer has the right to use the out-of-court dispute resolution procedure.

  1. COOKIES

14.1. www.fortactical.com uses necessary cookies to ensure the website's operation and, with the Buyer's consent, analytical and marketing cookies to improve the quality of website services and provide personalized content.

14.2. For more information about the use of cookies, their types, and management options, see the Privacy Policy: www.fortactical.com/privatumo-politika.

14.3. The Buyer can change cookie settings in their browser at any time.

  1. SPECIAL PROVISIONS ACCORDING TO THE NATURE OF THE GOODS

15.1. Tactical Clothing and Equipment:    a) Tactical clothing items (uniforms, vests, trousers, jackets) are designed for intensive use in outdoor conditions, but their durability depends on the intensity of use and maintenance.    b) Color stability may vary depending on the type of fabric, dyeing technology, and operating conditions.    c) Camo colors (Multicam, A-TACS, Kryptek, etc.) may have manufacturing shade differences between batches – this is not a defect.

15.2. Customized Goods:    a) Goods with printing, embroidery, special logos, or inscriptions are made according to the Buyer's order and are not returned without quality defects.    b) Before starting production, the Buyer may be sent a visualization mockup for approval (depending on the complexity of the order).    c) The Buyer is responsible for the quality and legality (copyright, trademarks) of the submitted files, logos, and texts.

15.3. Territorial and Product Restrictions:    a) Certain tactical equipment items may be restricted from being exported to certain countries under international trade requirements.    b) If legislation prohibits the sending of specific goods to the Buyer's country, the Seller has the right to refuse to fulfil the order, and the money paid will be refunded within 7 business days.    c) The Buyer confirms that they are familiar with the restrictions in force in their country regarding the acquisition and use of tactical equipment.

15.4. Hygiene and Safety Requirements:    a) Thermal underwear, balaclavas, gloves, and other products intended for skin contact are not returned if the original packaging is damaged, except in cases of quality defects.    b) Masks, respirators, and other personal protective equipment are not returned under any circumstances for hygiene reasons.

  1. SUPPORT FOR UKRAINIAN MANUFACTURERS

16.1. fortactical.com aims to support the Ukrainian textile and tactical equipment industry, and the majority of goods are manufactured in Ukraine.

16.2. By purchasing at fortactical.com, Buyers contribute to strengthening the Ukrainian economy and supporting employment.

16.3. The Seller ensures that it cooperates only with verified Ukrainian manufacturers who comply with international labor law and quality standards.

16.4. Information about a specific manufacturer, place of production, and certificates can be provided upon request by email at info@fortactical.com.

  1. BUSINESS CLIENTS (B2B)

17.1. Special pricing, payment, and delivery terms may apply to legal entities and business clients under an individual agreement.

17.2. Wholesale orders, uniform sets for companies and organizations are discussed individually. Contact: info@fortactical.com.

17.3. Long-term supply contracts with loyalty discounts and special payment terms can be concluded.

17.4. Business clients may be given the opportunity to purchase with deferred payment (transfer by invoice with payment term) if a corresponding agreement is concluded.

17.5. Public procurement: fortactical.com can participate in public procurement procedures. For participation in tenders, please contact info@fortactical.com.

  1. FINAL PROVISIONS

18.1. These Rules are drawn up in accordance with Articles 6.22810–6.22814 of the Civil Code of the Republic of Lithuania regarding withdrawal from a distance contract, the Rules for Retail Trade approved by Resolution No. 697 of the Government of the Republic of Lithuania of June 17, 2001, and other legal acts of the European Union and the Republic of Lithuania.

18.2. All notices related to these Rules are provided to the Buyer at the email address specified by them; to the Seller by the Buyer – by email to info@fortactical.com or by phone +37068585958.

18.3. Upon updating the Rules, they are immediately published on www.fortactical.com, and the version of the Rules in effect at the time of placing the order applies to specific orders.

18.4. If any provision of the Rules is recognized as invalid, this does not affect the validity of the other provisions.

18.5. These Rules come into force from the date of their publication on the www.fortactical.com website.
